4. Pre-Owned Products

Pre-owned products are previously owned or used devices that have been inspected and assessed by Gadgets and Games.

Depending on the product and condition, pre-owned devices may have cosmetic signs of previous use.

The condition of each pre-owned device may vary and customers should review the applicable product description and condition information before purchasing.

Pre-owned products are subject to the applicable warranty and return terms published by Gadgets and Games.

5. Device Age & Performance

Customers are responsible for familiarising themselves with a device's age, specifications, features and expected performance before purchasing.

Older devices may naturally have:

  • Slower performance compared to newer models

  • Reduced battery life or battery capacity

  • Limited, discontinued or unsupported software and security updates

These characteristics are normal considerations when purchasing older technology and do not necessarily indicate that a device is defective.

By purchasing a device, the customer acknowledges that they have considered the device's age, specifications and expected performance.

Nothing in these Terms of Service limits any consumer rights that cannot legally be excluded under South African law.

6. Pricing

All prices displayed on our website are in South African Rand (ZAR) unless otherwise stated.

We reserve the right to:

  • Change product prices at any time

  • Correct pricing errors

  • Update promotions and discounts

  • Withdraw products or promotions without prior notice

A pricing error does not automatically create an obligation to supply a product at an incorrect price where applicable law permits the order to be cancelled or corrected.

7. Product Availability

All products are subject to availability.

Adding a product to a shopping cart does not guarantee that the product will remain available until checkout or payment has been completed.

Where a product becomes unavailable after an order has been placed, Gadgets and Games will contact the customer and, where appropriate, offer a replacement, alternative solution or refund in accordance with applicable law.

An order is subject to acceptance and availability.

Gadgets and Games reserves the right to refuse, cancel or limit an order where reasonably necessary, including where:

  • Payment cannot be verified

  • Multiple orders appear to have been placed for fraudulent or abusive purposes

Where an order is cancelled after payment has been received, any applicable refund will be processed in accordance with our Return & Refund Policy and applicable South African law.

9. Payment

Customers must pay for orders using the payment methods made available through our website or agreed with Gadgets and Games.

For security and fraud-prevention purposes, we may:

  • Verify payments

  • Request additional information reasonably necessary to verify a transaction

  • Delay dispatch until payment has cleared

  • Refuse transactions reasonably suspected of fraud or unauthorised activity

Ownership of a product remains with Gadgets and Games until payment has been received in full and cleared, to the extent permitted by law.

10. Delivery

Customers are responsible for providing accurate delivery information.

Delivery times displayed on the website are estimates unless a specific delivery date or time has been expressly guaranteed.

Delays may occur due to circumstances outside our reasonable control, including courier delays, weather, strikes, public holidays or other unforeseen events.

Customers should inspect their package upon delivery and notify Gadgets and Games as soon as reasonably possible if the package appears damaged or items are missing.

Delivery and courier matters are also subject to the terms contained in our Return & Refund Policy.

11. Warranty

Products purchased from Gadgets and Games may be covered by the applicable warranty stated on our website or provided at the time of purchase.

Our current warranty terms provide:

  • Pre-owned devices: 6-month repair warranty

  • New devices: 12-month warranty

Warranty claims are subject to inspection, assessment and the applicable warranty exclusions.

Nothing in these Terms of Service limits any statutory consumer rights that apply under South African law.

12. Returns & Refunds

Returns, cancellations, replacements and refunds are governed by our Return & Refund Policy.

Customers should review that policy before completing a purchase.

Nothing in our Return & Refund Policy or these Terms of Service is intended to exclude or limit consumer rights that cannot legally be excluded under South African law.

13. Trade-Ins

Gadgets and Games may accept trade-in devices at its discretion.

All trade-ins are subject to inspection and testing.

Any initial or estimated trade-in value may be adjusted following inspection if the device differs from the information originally provided or if faults, damage or other issues are discovered.

By submitting a device for trade-in, the customer confirms that they are the lawful owner of the device and that it is:

  • Not stolen

  • Not financed

  • Not blacklisted

  • Not counterfeit

  • Not unlawfully obtained

Devices may be refused where ownership cannot reasonably be established or where the device does not meet our trade-in requirements.

14. Device Ownership & Activation Locks

Customers purchasing or selling devices are responsible for ensuring that devices are not subject to account, security or activation restrictions that prevent lawful use or transfer.

For trade-ins and returns, customers may be required to remove:

  • iCloud / Apple Activation Lock

  • Google Factory Reset Protection (FRP)

  • Samsung or other manufacturer account locks

  • Passwords and other security restrictions

Gadgets and Games may delay or refuse processing where a device cannot reasonably be tested, transferred or processed because of an unresolved activation or security lock.

15. Intellectual Property

All content appearing on the Gadgets and Games website, including but not limited to:

  • Logos

  • Brand names

  • Product descriptions

  • Images

  • Graphics

  • Website design

  • Text

  • Videos

  • Marketing materials

is owned by or licensed to Gadgets and Games or its relevant third-party suppliers and is protected by applicable intellectual property laws.

You may not reproduce, modify, distribute, publish or commercially exploit our content without our prior written permission, except where permitted by law.
