Refund policy
Return & Refund Policy
Effective Date: 4 August 2026
At Gadgets and Games (Pty) Ltd, we want our customers to feel confident when purchasing from us. This Return & Refund Policy explains when returns, cancellations, replacements and refunds may be accepted.
Please read this policy carefully before placing an order.
1. General Returns Policy
All sales are considered final unless a return, cancellation, replacement or refund is required under applicable South African law, including the Consumer Protection Act 68 of 2008 (CPA) and the Electronic Communications and Transactions Act 25 of 2002 (ECTA).
Where a product is defective, not as described, or otherwise qualifies for a remedy under applicable law, Gadgets and Games will provide the appropriate remedy as required by law.
Depending on the circumstances, this may include:
-
Repair
-
Replacement
-
Refund
-
Other appropriate remedies available under applicable law
2. Change of Mind & Buyer's Remorse
Gadgets and Games does not generally accept returns or provide refunds simply because a customer:
-
Has changed their mind
-
No longer wants the product
-
Purchased the incorrect product
-
Finds the same or a similar product at a lower price elsewhere
-
Decides that the product does not meet their personal preferences
This does not affect any statutory consumer rights that may apply to the transaction.
3. Online Purchases
For purchases made online, customers may have certain cancellation or cooling-off rights under the Electronic Communications and Transactions Act 25 of 2002 (ECTA) and other applicable South African legislation.
Where a statutory cooling-off or cancellation right applies, the customer may exercise that right within the applicable period and in accordance with the requirements of the relevant legislation.
Any product returned under a statutory cooling-off right must be returned in accordance with the applicable legal requirements.
4. Faulty or Defective Products
If you believe that a product is faulty or defective, please contact Gadgets and Games as soon as possible.
The product may need to be returned to us for inspection and assessment before a return, repair, replacement or refund is approved.
Customers should provide:
-
Valid proof of purchase
-
The product
-
A description of the fault or issue
-
Any relevant photographs or videos where requested
Where the product is found to have a defect covered by applicable law or the product's warranty, the appropriate remedy will be provided in accordance with applicable South African law.
5. Incorrect or Misrepresented Products
If you receive a product that is materially different from the product described or ordered, please contact us as soon as possible.
Gadgets and Games will assess the issue and, where appropriate, arrange for the product to be corrected, repaired, replaced or refunded in accordance with applicable law.
6. Condition of Returned Products
Where a return is permitted, customers may be required to return the product together with any relevant accessories, packaging or items supplied with the purchase.
Customers should ensure that products are packaged securely when returning them.
Where applicable, the condition of the returned product may be considered when determining the appropriate remedy, subject to the customer's statutory rights.
7. Personal Data & Device Security
Before returning any electronic device, customers are responsible for:
-
Backing up their personal information and data
-
Removing personal accounts
-
Removing passwords and security locks
-
Removing iCloud, Google FRP and similar activation or device protection
Gadgets and Games is not responsible for any loss of personal data during the return, inspection, repair or replacement process.
Where a device remains locked to a customer's account, this may delay the return, inspection or processing of the claim.
8. Refunds
Where a refund is approved, the refund will generally be processed using the same payment method used for the original purchase, where reasonably possible.
Refund processing times may vary depending on the payment provider or financial institution.
Gadgets and Games will not be responsible for delays caused by third-party payment providers or financial institutions.
A refund will only be processed once the relevant return or claim has been assessed and approved.
9. Delivery & Return Costs
Where a return is required because of a confirmed defect, incorrect product or another circumstance where Gadgets and Games is legally responsible for the return, return-related costs will be handled in accordance with applicable South African law.
Where a customer requests a return for a reason that is not covered by a statutory right or an agreed return arrangement, the customer may be responsible for the applicable return or delivery costs.
10. Non-Returnable Circumstances
A return or refund may not be accepted where the issue is caused by:
-
Accidental or liquid damage
-
Physical damage caused after delivery
-
Misuse, abuse or negligence
-
Unauthorised repairs or modifications
-
Normal wear and tear
-
Software changes or issues caused by the customer
-
Viruses or malware
-
Removal, alteration or tampering with the device's IMEI or serial number
These exclusions do not limit any consumer rights that cannot legally be excluded under South African law.
11. Pre-Owned Devices
Pre-owned devices may show reasonable signs of previous use, including cosmetic wear, depending on the condition or grade of the device advertised.
Normal cosmetic wear, age-related characteristics and expected differences between pre-owned devices do not automatically constitute a defect.
Customers are encouraged to carefully review the product description, photographs, specifications, condition and warranty information before purchasing.
12. Device Age & Performance
Customers are responsible for familiarising themselves with a device's age, specifications, features and expected performance before purchasing.
Older devices may naturally have:
-
Slower performance compared to newer models
-
Reduced battery life or battery capacity
-
Limited, discontinued or unsupported software and security updates
These characteristics do not necessarily indicate that a device is faulty or defective.
A customer cannot request a return or refund solely because an older device performs differently from a newer model, where the device performs in accordance with its advertised specifications and applicable warranty or consumer rights.
This section does not limit or exclude any consumer rights that cannot legally be excluded under South African law.
13. How to Request a Return
To request a return, customers should contact Gadgets and Games and provide:
-
Full name
-
Proof of purchase
-
Order details
-
Product details
-
Reason for the return
-
Description of any fault or issue
Customers should not send products back without first contacting Gadgets and Games, as this may delay the processing of the return.
Each return will be assessed according to the circumstances of the transaction and applicable South African law.
14. Trade-In Transactions
Trade-ins are separate from ordinary product purchases and are subject to inspection and approval.
A trade-in value may be adjusted following inspection if the device has faults, damage or issues that were not disclosed during the initial assessment.
Gadgets and Games reserves the right to refuse a trade-in where the device does not meet the applicable requirements.
