Where a warranty claim is valid, Gadgets and Games may repair the device or replace it with an equivalent device where repair is not reasonably possible, subject to applicable South African law.
2. Device Age & Performance Disclaimer
Customers are responsible for familiarising themselves with a device's specifications, age, features and expected performance before purchasing.
Gadgets and Games (Pty) Ltd cannot be held liable for limitations that may naturally occur due to the age of a device, including:
-
Slower performance compared to newer models
-
Reduced battery life or battery capacity
-
Limited, discontinued or unsupported software and security updates
These factors are considered normal characteristics of older technology and do not necessarily indicate a fault or defect with the device.
By proceeding with a purchase, the customer confirms that they have considered the device's age, specifications and expected performance and understand that older devices may have certain performance, battery and software limitations.
This disclaimer does not limit or exclude any consumer rights or remedies that cannot legally be excluded under applicable South African law.
3. Making a Warranty Claim
To submit a warranty claim, customers must provide:
-
Valid proof of purchase
-
The original device
-
A description of the fault or issue
All devices will be inspected and assessed before a warranty repair or replacement is approved.
A warranty claim may be declined if the reported fault falls outside the warranty exclusions or where permitted by applicable law.
4. Customer Responsibilities
Before submitting a device for inspection, repair or replacement, customers are responsible for:
-
Backing up all personal information and data
-
Removing passwords and activation locks where required
-
Removing security locks such as iCloud, Google FRP and similar device protection
Gadgets and Games is not responsible for any loss of data that occurs during the inspection, repair or replacement process.
5. Warranty Exclusions
A warranty claim may be excluded where:
-
The device's IMEI or serial number has been removed, altered or tampered with
-
The device has been opened, repaired or modified by an unauthorised repairer
-
The device has been misused, neglected or abused
-
The device has suffered liquid or accidental damage
-
The issue is the result of normal wear and tear
These exclusions are subject to any consumer rights that cannot legally be excluded under South African law.
6. Returns & Refunds
All sales are considered final unless a return, cancellation, replacement or refund is required by applicable South African law, including the Consumer Protection Act 68 of 2008 (CPA) and the Electronic Communications and Transactions Act 25 of 2002 (ECTA), or is otherwise agreed to in writing.
We do not accept returns, exchanges or refunds for:
-
Buyer's remorse
-
Change of mind
-
Deciding that the product is no longer wanted
-
Purchasing the incorrect product
-
Finding the same or a similar product at a lower price elsewhere
For in-store purchases, returns due to buyer's remorse or change of mind will not be accepted, subject to applicable statutory consumer rights.
For online purchases, any mandatory cooling-off or cancellation rights provided by South African law will apply.
Where a return is approved, the resolution may include repair, replacement or refund, as permitted by applicable law.
7. Trade-Ins
Trade-ins are accepted at the discretion of Gadgets and Games and are subject to inspection and testing.

Delivery times are estimates unless a specific delivery time has been expressly guaranteed.
Customers should inspect their parcel upon delivery and report any visible damage or missing items as soon as possible.
Where appropriate, Gadgets and Games will reasonably assist customers with courier-related claims.
Risk of loss or damage will be handled in accordance with applicable South African law.
10. Blacklisted Devices
If a device purchased from Gadgets and Games becomes blacklisted during its applicable warranty period for reasons not caused by the customer, Gadgets and Games reserves the right to investigate the circumstances before approving a replacement claim.
Customers may be required to provide proof of purchase, identification and other reasonable information required to assist with the investigation.

The replacement device will have:
